A portable breath test is often used in the field by law enforcement to gather quick and conclusive evidence that you were operating your motor vehicle while under the influence. Often, this test is not accurate. Even if you submit to a breath test in the field, the officer can request a blood or urine test while you are in custody.

In my opinion, a breath test cannot accurately determine the blood alcohol content (BAC) of a driver; a blood test would be needed to calculate BAC. However, blood tests are not performed in the field by law enforcement, so police use a breath test to answer whether or not alcohol is in your system.

A Breathalyzer or other breath test is a machine with inherent instabilities, including:

  • Was the machine calibrated or maintained correctly?
  • Was the test administrator properly trained?
  • Was the test administered properly?
  • Were the test results contaminated by other chemicals in the air?
  • Was the accused person exposed to chemical inhalants like paint vapors or varnish prior to the test? These chemicals might compromise the accuracy of the test results.
